If a tree falls on a property line, and there’s no one around to hear it… who’s insurance company pays? According to Ann Cochran with houselogic.com, it depends.When a tree falls over a property line from a neighbor’s yard, your insurance will deal with the damage to your property first, and then decide later whether or not to go after reimbursement from your neighbor’s insurance – this decision is based on whether or not you can prove the neighbor was aware the tree was a hazard that they then failed to fix.

The lesson? If your neighbor has a suspect tree, write them a letter describing the issue, photographing and documenting the issue, and requesting action to fix it. Cochran writes that this can be on attorney letterhead if you want to show “you mean business”, but it’s not necessary.

If your tree falls – don’t do anything until an insurance company for your neighbor contacts, you. Keep receipts from pruning or other tree care you’ve done to prove you’ve acted responsibly.
